Senator Wyden is highlighting an important provision in this week's landmark health care legislation that empowers states to adopt their own models of reform - as long as they meet the baseline criteria for affordable, quality health care.
Under the amendment, states would be able to apply for a waiver to add a public option or consider alternatives to the individual mandate that Republicans are threatening to challenge in the courts.
"I think these lawsuits are going nowhere, they really aren't even needed," the Senator told MSNBC's Ed Shultz. ""Why don't you work with us, innovate rather than litigate."
